***EPA to Make Announcement Today on Petroleum Industry RFS Lawsuits

EPA will make an announcement later today related to lawsuits filed by the petroleum industry on EPA’s failure to finalize the 2014 and 2015 Renewable Fuel Standard (RFS2) targets by their statutory deadline, sources familiar with the issue have confirmed to OPIS.

EPA did not immediately return requests for comment by presstime.

The agency has yet to finalize its 2014 or 2015 RFS targets, which were due by Nov. 30, 2013, and Nov. 30, 2014, respectively.

On Nov. 21, 2014, the American Fuel & Petrochemical Manufacturers (AFPM) filed a notice of intent to sue EPA related to the agency’s failure to issue the 2014 targets by the statutory deadline, and on Dec. 1, 2014, both AFPM and the American Petroleum Institute (API) filed their notice of intent to sue EPA related to the 2015 target.

Meanwhile, on March 18, AFPM and API filed a lawsuit in the U.S. District Court for the District of Columbia against EPA for the agency’s failure to issue both the 2014 and 2015 RFS targets by their deadlines.

In February, an EPA official told the Renewable Fuels Association conference that the agency plans to propose the 2014, 2015 and 2016 targets this spring.
